This Return and Refund Policy explains how purchases, credits, compute usage, API usage, cancellations, refunds, and expired balances work for PTX Kernel Factory.
This Policy forms part of the Terms and Conditions for PTX Kernel Factory. Capitalized terms not defined in this Policy have the meanings given to them in the Terms and Conditions.
Digital Service; No Physical Returns
PTX Kernel Factory is a digital software and compute service. We do not sell physical goods through the Service, and there are no physical products to return.
Credits
The Service may require You to purchase prepaid credits before using certain paid functionality. Credits may be used to pay for usage of the Service, including compute, GPU access, API calls, model usage, benchmarking, compilation, testing, storage, related platform fees, and other metered functionality made available through the Service.
Credits are not legal tender, currency, a stored-value account, or a deposit account. Credits have no cash value and may not be redeemed for cash.
Credits may only be used by the Account or organization to which they are issued. You may not sell, transfer, assign, exchange, or sublicense credits unless We expressly agree in writing.
Non-Refundable Credits
All credit purchases are final and non-refundable, except where a refund is required by applicable law or expressly agreed by Us in writing.
Unused credits are not refundable when You stop using the Service, cancel a subscription, close an Account, downgrade a plan, remove users, lose access due to suspension or termination, or fail to use credits before they expire.
We may, in Our sole discretion, issue account credits, courtesy credits, promotional credits, service credits, or other accommodations. Any such accommodation does not create an obligation to provide the same or similar accommodation in the future.
Credit Expiration
Purchased credits expire one year from the date of purchase or issuance, unless a different expiration period is stated at the time of purchase or in a written agreement signed by Us.
Promotional, free, trial, bonus, courtesy, or service credits expire at the time stated when issued. If no expiration time is stated, they expire one year from the date of issuance.
Expired credits cannot be used, recovered, extended, redeemed, transferred, or refunded, except where required by applicable law or expressly agreed by Us in writing.
If Your Account or organization is closed, suspended, or terminated, credits associated with that Account or organization may expire or be forfeited according to the Terms and Conditions and applicable law.
Usage Charges
Your credits will be deducted according to the pricing, metering, and usage rules shown in the Service, on Our website, in an order form, or in a written agreement with Us.
Usage charges may include, without limitation:
- GPU compute time
- Cloud compute, storage, networking, or infrastructure usage
- Third-party API or model usage
- PTX Kernel Factory platform fees
- Compilation, execution, testing, benchmarking, evaluation, logging, and diagnostics
- Other usage-based products, features, or services
You are responsible for monitoring Your credit balance, usage, auto-reload settings, spending limits, and billing activity.
We may stop, throttle, suspend, or limit access to paid functionality if Your credit balance is insufficient, Your payment method fails, Your account has a billing issue, or We reasonably determine that usage presents financial, security, legal, operational, or abuse risk.
Failed, Interrupted, or Unsuccessful Runs
PTX Kernel Factory performs technical work that may involve compilation, testing, benchmarking, API calls, model calls, GPU execution, and other compute-intensive operations. You may be charged for completed tasks and for resources consumed even if a run, candidate, benchmark, optimization, kernel, result, or output is unsuccessful, incomplete, unsuitable for Your use case, or does not meet Your expectations.
We generally do not charge for requests or tasks that fail before any chargeable compute, API, model, storage, or platform resource is allocated or consumed.
We generally do not charge for usage that We determine was not processed because of a billing-system error or platform-side metering failure. If You believe You were incorrectly charged, contact Us as described below.
Auto-Reload and Recurring Credit Purchases
The Service may allow You to enable automatic credit reloads or other balance-maintenance functionality. If You enable auto-reload, You authorize Us or Our payment processor to charge Your selected payment method when Your credit balance falls below the threshold or according to the rules You configure.
Credits purchased through auto-reload are subject to the same non-refundable and expiration terms as other purchased credits.
You are responsible for disabling auto-reload if You no longer want additional credits to be purchased.
Subscriptions and Plan Fees
Subscription fees, access fees, platform fees, seat fees, minimum commitments, and other recurring or fixed fees are separate from usage credits unless expressly stated otherwise.
Cancellation of a subscription stops future subscription renewals according to the cancellation terms shown in the Service or in Your applicable agreement. Cancellation does not refund previously paid subscription fees, access fees, platform fees, seat fees, minimum commitments, used credits, unused credits, or expired credits, except where required by applicable law or expressly agreed by Us in writing.
Billing Errors
If You believe there is a billing error, duplicate charge, unauthorized charge, incorrect credit deduction, or other payment issue, contact Us promptly at info@int21.ai.
To help Us investigate, include:
- The email address associated with Your Account
- The organization or workspace name, if applicable
- The relevant invoice, receipt, payment, or transaction ID
- The date and amount of the charge or credit deduction
- A brief description of the issue
We may ask You to provide additional information to verify Your identity, authority, and billing issue.
Unless a longer period is required by applicable law, You must notify Us of billing errors within 30 days after the charge, invoice, credit purchase, or credit deduction at issue.
If We determine that a billing error occurred, Our remedy may include correction of the error, restoration of credits, issuance of account credits, or a refund to the original payment method, as We determine appropriate or as required by law.
Taxes
Prices may not include taxes, duties, levies, or similar governmental assessments unless expressly stated. You are responsible for all applicable taxes associated with Your purchases and use of the Service, except for taxes based on Our net income.
Tax calculations may depend on the billing information You provide. You are responsible for providing accurate and current billing, tax, and location information.
Chargebacks and Payment Disputes
If You initiate a chargeback, payment reversal, or payment dispute, We may suspend or limit Your Account while the dispute is investigated.
If a chargeback or payment reversal is resolved against Us, We may deduct the disputed amount from Your credit balance, disable credits associated with the disputed payment, suspend paid functionality, or terminate access as permitted by the Terms and Conditions and applicable law.
Changes to Pricing and Credits
We may change pricing, credit packages, usage rates, metering rules, minimum purchase amounts, auto-reload options, and available paid features from time to time.
Unless otherwise stated, pricing changes apply prospectively and do not extend the expiration date of existing credits.
Exceptions Required by Law
Some jurisdictions may provide mandatory refund, cancellation, withdrawal, chargeback, tax, consumer protection, or other rights that cannot be waived by contract.
Nothing in this Policy limits any non-waivable rights You may have under applicable law.
Conflicts
If this Policy conflicts with a written agreement, order form, statement of work, or enterprise agreement signed by both You and the Company, the signed agreement controls to the extent of the conflict.
If this Policy conflicts with the Terms and Conditions and there is no signed agreement that controls, this Policy controls solely with respect to returns, refunds, credits, credit expiration, billing errors, and usage charges.
